El trabajo consiste en una elucidación de los elementos que conforman el concepto de pena natural (poena naturalis) en el Derecho penal. Se puede caracterizar la pena natural como el daño o sufrimiento que recae sobre el autor de un delito, producto de la comisión del mismo, que debe ser descontado de la pena legal que ha de aplicársele. Si bien existe un mínimo acuerdo sobre esto, tanto en la jurisprudencia como en la doctrina penal se observan serios desacuerdos acerca (...) de los requisitos que se deben cumplir para reconocer que se está frente a una pena natural. Para elucidar los elementos, se utilizará el constructivismo conceptual de Ronald Dworkin, a fin de describir el desacuerdo y sus implicancias, reconocer los elementos principales de la pena natural y justificarlos bajo su mejor luz moral. ABSTRACT This study focuses on the clarification of the conceptual elements of poena naturalis in criminal law settings. The poena naturalis is the damage or suffering that falls on the convict for its commission. This damage must be deducted from the poena forensis to be applied. Although there is a minimum agreement about the concept of poena naturalis, in the jurisprudence and among legal scholars, there are serious disagreements about the elements of poena naturalis. To elucidate the elements, I will adopt Ronald Dworkin’s conceptual constructivism to describe the disagreement and its implications. La mal llamada “Conquista del Desierto” constituyó una serie de campañas militares ocurridas en el actual territorio patagónico argentino entre los años 1878 y 1885 cuyo resultado fue el asesinato, la violación y sometimiento a la esclavitud de diversos pueblos y comunidades indígenas. Este no fue un caso aislado, sino que se suma a una serie de ataques sistemáticos que han sufrido los indígenas en la Argentina. En los últimos años, a raíz del reclamo y las luchas de los pueblos (...) y comunidades indígenas, así como también de las organizaciones de derechos humanos, se han comenzado a juzgar algunos de estos hechos. En particular, la Masacre de Napalpí (1924) y la Masacre de La Bomba (1947) fueron los primeros que lograron respuestas judiciales favorables. En ambos se determinó que el accionar estatal era constitutivo de un genocidio y, por lo tanto, se debía resarcir a las comunidades actuales. Ahora bien, la Campaña del Desierto, al día de hoy, no tiene respuesta por parte del Estado. Teniendo presente este panorama, nuestro objetivo en este trabajo es reconstruir los diferentes problemas que enfrenta la posibilidad del reclamo judicial. Para ello, comenzaremos describiendo en qué consistió la Campaña del Desierto. Luego, explicaremos la noción de genocidio aplicado a hechos de injusticias históricas. Como tercer paso, reconstruiremos los casos jurisprudenciales que se han preocupado por genocidios indígenas ocurridos en el pasado. Con este panorama revelado, nos enfocaremos en los diferentes problemas jurídicos y políticos que surgen en los reclamos de justicia. (shrink)

En la literatura jurídico penal, el arrepentimiento cobra relevancia en un lugar específico: la condena, más precisamente, en la determinación de la pena del sujeto que ha sido encontrado responsable por la comisión de un delito y que, a su vez, se encuentra arrepentido por su accionar. Desde la concepción comunicativa del castigo, en este trabajo contestaré las siguientes preguntas: ¿El arrepentimiento significa un menor reproche penal o es indiferente para la determinación de la pena? en caso de que implique (...) un acercamiento al castigo mínimo establecido en la legislación ¿Cuándo es razonable que esto suceda? In the present work I am interested in addressing a specific aspect within the conceptual problem that poena naturalis implies. In other words, here I will answer the question about what is the poena naturalis. We can be recognized three theories: one that affirms that the poena naturalis is a compensation for culpability, another according to which the poena naturalis is the product of clemency or compassion, and the last that defends that the principles of legality, proportionality and rationality allow (...) justifying the poena naturalis. I will stop at each one of them in order to carry out a critical examination that will allow me to conclude which is the conception that best supports natural punishment. (shrink)

La doctrina establecida por la Corte Suprema de Justicia de la Argentina en relación a los crímenes de lesa humanidad cometidos durante la última dictadura militar, expresamente declaraba la obligación del Estado de investigar y juzgar a los responsables de su comisión. La Corte no sólo caracterizó dichos delitos, sino que también estableció que no eran susceptibles de amnistía, indulto, ni prescripción. Pero, en el año 2017 dictó el fallo “Muiña” donde, por voto mayoritario, decidió otorgarle el beneficio del “2 (...) por 1” a un condenado por dichos delitos. La consecuencia fue su inmediata libertad por el vencimiento de la condena. La respuesta de la sociedad fue clara. Con diversas manifestaciones, la sociedad civil, las instituciones y las personalidades públicas se declararon en contra de la sentencia. Más aún, del voto de los mismos jueces se observan expresiones que denotan un gran pesar a la hora de tomar la decisión. Más precisamente, sostenían estar ante un dilema. En este trabajo, lejos de realizar un análisis de la interpretación jurídica que se efectuó en la sentencia, se propone trabajar sobre el concepto de dilema y la posibilidad de aplicación en el presente caso. La finalidad concreta es indagar si se está ante un dilema y en su caso si los jueces utilizan este concepto como un arma argumentativa para lograr adhesión o compasión de la opinión pública. En este sentido, se comenzará relatando el marco jurídico del fallo, donde se describirá la historia judicial de Muiña y los argumentos dados por el voto mayoritario y el minoritario de la Corte. Luego, se realizará un análisis del concepto de dilema, para reconstruirlo sobre la base de dos grandes posturas: Una lógica conceptual y otra fenomenológica. Posteriormente, se realizará un examen de la dimensión institucional del derecho y la moralidad judicial, para - finalmente - poder intentar responder si se está efectivamente ante un dilema. Malem Seña in “¿Puede las malas personas ser buenos jueces?” analyzed the judicial morality. At first time from a historical analysis, the judges were not required to base their judgments, because they were the mirror of legitimacy and morality of their decisions. With the advent of rationalism and modern State, the sentences should be the foundation. The situation that put the judge person in the background. In this situation, the answer to the question posed in the job would be: "Yes, (...) bad people can be good judges", answer hardly accepted by all. Malem Seña, far from giving a definite answer, ends his work with the insinuation that judges should maintain an image of morality, rather than being morally unimpeachable agents. This situation raises questions about different dimensions of analysis that have been shelved, and in particular try to analyze why this importance takes the image of morality. To do this, from the perspective of the concepts of Slavoj Žižek‘s ideology and fantasy, it will attempt to reach some responses or generate argumentative lines about the importance of the image of morality on morality itself. There is a close relationship between education and citizenship. Liberal political theorists tend to spend much of their work justifying the role of educational institutions in political communities. However, the development of these proposals is usually thought for subjects who do not have disabilities, arbitrarily excluding a significant proportion of society. This not only happens at an educational level, it is replicated in various areas of social life. In this sense, in the present work I am going to propose that (...) the adequacy approach proposed by Debra Satz is extremely valuable to think about the educational equity of people with disabilities. The choice is not accidental or arbitrary. Satz is a renowned philosopher whose interest in education and its importance in forming citizens for diverse and plural societies. To do this, I will begin by presenting three possible models of special education: the special school, integration and inclusion. Then the two paradigms that prevail in the characterization of disability will be addressed: the social model and the medical model. Instead, I will reconstruct the third proposal elaborated by Satz in order to evaluate with which inclusive education model and disability paradigm it is compatible and why it is presented as a valuable proposal in this field. Our purpose is to describe the application of legitimate defense in so-called non-confrontational situations. To do this, we will conceptualize gender violence as that which against women, due to their condition as such, and we will describe the absence by the courts in the identification of this problem. Second, we will analyze the reception of Argentine and international legislation on the treatment of gender violence and the recommendations and criteria to take into account when interpreting and applying criminal law. Finally, (...) we will present the treatment of legitimate defense in contexts of gender violence, analyzing each of its elements. Our conclusions will focus on the need to address situations of gender violence based on international regulations for the application of legitimate defense in non-confrontational situations. The aim of this paper is to analyze a selection of arguments used by the Argentine Supreme Court to reduce the sentence of individuals convicted of crimes against humanity. The focus will be primarily centered on “Muiña´s case”, in which a lenient outdated ruling was made. The questions that this work will try to answer revolve around the court´s merit in issuing this lenient ruling to Muiña´s case and its justification. First, Muiña´s case is analyzed in depth. Then, a critical (...) analysis about the ruling and a decision concerning the existence of a true justification will be developed. Finally, we will discuss the appropriateness of the Court’s decision in Muiña´s case as opposed to the decision made in “Batalla´s case”, in which a less beneficial law was applied retroactively. In this paper, we analyze the origin of the links between global bioethics (which we differentiate from biomedical bioethics) and human rights. We understand that we are in a global civilizational crisis, whose roots extend to 1492 today, in which the modern-capitalist model used the discourse of human rights to justify its predatory technocracy. There are three theoretical assumptions that support our analysis: 1) The current conditions in which the technique shows its destructive power over nature (Anthropocene) indicate that none (...) of the ethical antecedents are applicable to such circumstances. In this new context, the kantian categorical imperative has been reconverted into a moral and political duty to not instrumentalize either human beings or nature. We call this new ethical consideration bioethics. 2) The current geopolitical composition of the world must be thought in terms of the global North and the global South, as two regions that are forged in the midst of important processes of globalization of the world-system, and whose main consequence lies in the absence of equity in the distribution of wealth and well-being between the two. 3) The current environmental crisis or climate change, the product of an economic model based on extractive technology, has become one of the most serious threats against human rights. Se aplicó el asistente de prueba Tree Proof Generator (TPG) para determinar la corrección lógica de la primera vía tomista sobre la existencia de Dios, así como la corrección de algunas relaciones conceptuales en metafísica modal (necesidad y posibilidad), en epistemología (conocimiento) y en la formulación estructural del árbol de Porfirio. La investigación procura no solo abordar las tesis en cuestión desde el punto de vista computacional, sino que ofrece un marco reflexivo sobre tres condiciones necesarias para una filosofía asistida (...) por computadora; en tal sentido, la investigación se compromete con la idea de que la filosofía es análisis conceptual y argumentación, que pensar filosóficamente no supone un privilegio epistémico o cognitivo y que se requiere de un lenguaje formalmente especificable para ‘hacer’ filosofía. Testimonial injustices occur when individuals from particular social groups are systematically and persistently given less credibility in their claims merely because of their group identity. Recent “pluralistic” approaches to folk psychology, by taking into account the role of stereotypes in how we understand others, have the power to explain how and why cases of testimonial injustice occur. If how we make sense of others’ behavior depends on assumptions about how individuals from certain groups think and act, this can explain why (...) speakers are given different degrees of credibility depending on their group identity. For example, if people assume that women are more emotional than men, they will systematically give less credibility to women’s claims. This explanation involves three empirical claims: people assume that women are more emotional than men, people assume that emotionality hinders credibility, and people give less credibility to women’s claims. While extant studies provide some support for and, no study to date has directly tested. In two different studies, we tested all these three claims. The results from both studies provide support for, as we found significant negative correlations between emotionality and credibility attributions. However, in contrast to what some accounts of folk psychology posit, we did not find any significant difference in people’s attributions of emotionality and credibility towards women versus men speakers. We hope that our studies here pave the way for further empirical studies testing the phenomenon of testimonial injustice in a context-sensitive way, in order to have a better understanding of the conditions in which testimonial injustices are likely to happen. Objectives: The study determined the competencies of teachers and performance of learners in 2017-2018 National Achievement Test. It identified the influence of teachers’ competencies on performance of learners. Methods: It employed descriptive-correlational and explanatory designs and it involved three divisions in Northern Mindanao region, Philippines. Findings: The Grade 10 and 6 teachers have possessed very satisfactory competencies across areas, while the Grade 10 and Grade 6 learners had a low mastery and very low mastery, respectively. Furthermore, there was no significant (...) relationship between the competencies of teachers and the performance of learners, while their competencies did not significantly influence the performance of learners. Conclusion: Teachers were deemed competent in all areas and learners had not acquired most of the competency standards of the curricula. Hence, no matter how competent teachers are, this would not contribute significantly to improving the performance of learners in the National Achievement Test. Thus, competencies of teachers cannot determine the performance of learners. (shrink)

This work seeks to answer the question of whether the Internet is epistemically secure. The problem is approached from a double path (i) analytical (a priori, logical-philosophical) and (ii) empirical. For the first, the treatment is based on the logic of justification; while the second, in a survey in which respondents answer on the use and assessment of the information offered by the internet. The argument presented is as follows: If epistemic security requires the exercise or implementation of epistemic virtues (...) and those practices by the user are weak, then the Internet is not epistemically secure. Based on the established results, it is concluded that the internet is not epistemic safe and some risks that this entails are discussed. (shrink)

Si se identifica libertad con voluntad, se corre el riesgo de tomar a la primera como el único aspecto en que la voluntad se desenvuelve, es decir, considerar el querer como mera actualización de la libertad. Pero la libertad no es más que un aspecto parcial de la voluntad, un aspecto cualitativo del querer, pues el dinamismo de la voluntad procede de su naturaleza y no del hecho de la libertad del acto del querer. La relación entre la inteligencia y (...) la voluntad es lo que caracteriza al acto específicamente humano. Por ello, se impone el análisis de la reciprocidad de influencia de las dos facultades espirituales en su propia unidad viva y funcional, pues si bien el libre albedrío se identifica con el momento de la elección, la libertad recorre todo el acto humano. Puesto que la voluntad tiende naturalmente a lo que supone perfeccionamiento del hombre, la libertad debe fomentar en el caso concreto esa orientación natural de la voluntad, es decir, elevarla a la práctica en la realidad concreta. Que la libertad disponga de la posibilidad de obrar en contra o al margen de ella, es decir, de romper de alguna forma la orientación natural de la voluntad, violentándola y torciéndola, es un defecto y también una forma de esclavitud, pues el hombre cuando obra el mal peca actúa al margen de la razón, conduciéndose como si fuese movido por otro distinto de él mismo. La posibilidad de apartarse del bien no pertenece a la esencia y a la perfección de la libertad, pues ésta consiste en obrar según la razón, impulso propio de acuerdo con su naturaleza. Los dos planos o motivaciones determinantes en que se articula la voluntad, como son el querer natural y necesario y, además, el querer deliberado y libre, son imprescindibles para dar un enfoque correcto al problema de la libertad: pues lo importante es apreciar en la acción libre la parte que se debe a la naturaleza de la voluntad, dándose la libertad únicamente como posibilidad de poner por obra un acto volitivo de acuerdo o no con la orientación natural de aquélla. El interés de esta indagación se centra especialmente en la voluntad deliberada o amor electivo del Bien. Podrá comprobarse la armonía constitutiva que reina entre la intención del fin y la elección de los medios, tema central cuando se estudia la psicología y la filosofía moral de Santo Tomás de Aquino. Las siguientes páginas se deciden a favor de la distinción entre intención del fin -intentio finis- y elección de los medios -electio mediorum-, haciendo partícipe a la voluntad deliberada del último fin en concreto, es decir, de Dios, a través de la intención, salvando así el poder de autodeterminación de la voluntad hacia el fin último en concreto, con lo que se abren las puertas a la conducta moral del hombre. Santo Tomás enfoca el problema de la libertad sin excluir ninguno de los tres planos en los que se articula, como son el plano ontológico, el plano psicológico y el plano moral, ya que el hombre tiene el deber de realizar en cada momento el máximo de su libertad en orden al perfeccionamiento de su ser, en una costosa labor de autocreación y no de caprichosa elección. Así, pues, el mayor ejercicio de libertad humana está en decidirse por su último fin en concreto, es decir, por Dios, a través de una adecuada elección de medios y de una recta intención, pues el hombre, en tanto que criatura, procede de Dios, y en tanto que hombre, tiene su fin último en la glorificación de Dios, en un doble ritmo de procesión y de retorno, poniéndose así de manifiesto el carácter religioso de la moral. Es por ello que el problema de la libertad es, en último término, un problema metafísico, que consiste en el movimiento natural y deliberado de la persona humana hacia su plenitud. (shrink)

Este trabajo pretende comparar ambas alternativas concretadas cada una en un caso. En representación de la estrategia de la explicación (1), se usa un artículo de Weber quien defiende la estrategia de la inferencia de la mejor explicación. El presente texto es una guía para una primera lectura de los Los fundamentos de la aritmética de Gottlob Frege para estudiantes del grado de Filosofía. -/- No pretende hacer ninguna aportación a la investigación sobre Frege sino ofrecer los instrumentos para hacer una primera lectura mediante la recopilación y la ordenación de los textos relevantes de los estudiosos de Frege, especialmente de la literatura en inglés. En la mayor parte de los casos, las referencias a otros autores (Autorfecha) preceden (...) a una traducción de los escritos referidos así como una unificación de la terminología, el recorte de lo no relevante y el añadido de las explicaciones pertinentes para hacer el texto accesible a un estudiante del grado de Filosofía. En el caso de que la cita justifique una afirmación que no se desarrolla, se verá precedida por la palabra "ver" dentro del paréntesis de la referencia. El texto usado para las citas de Los fundamentos de la aritmética es la traducción de Ulises Moulines dado que el que esto escribe no sabe alemán. La guía no supone más matemáticas que las que se estudian en los cursos anteriores a la universidad. Sin embargo, es recomendable haber hecho un curso elemental de lógica matemática y teoría de conjuntos. La razón fundamental es que la formalización de ciertas proposiciones permite aclarar extremos que se hacen muy enojosos sin esos instrumentos. (shrink)

El autor trata de hacer balance, treinta años después, de lo que ha significado en el panorama del pensamiento jurídico la aparición de la Teoría del Derecho (Legal Theory, Rechtstheorie). El autor estudia los supuestos y razones del nacimiento de la Teoría del Derecho, como intento de superación de las limitaciones e insuficiencias del iusnaturalismo, del iuspositivismo y de su Teoría General del Derecho, así como de la Filosofía del Derecho postpositivista. Tras analizar el programa de la Teoría del Derecho (...) en sus direcciones anglosajona (Legal Theory) y alemana (Rechtstheorie), el autor hace un juicio de sus resultados (aportaciones e insuficiencias), postulando la posibilidad y necesidad de una Teoría Fundamental del Derecho que se configuraría como una ontología jurídica integral (material y formal al mismo tiempo). El día dieciséis de julio de este año, un día después de la festividad de san Buenaventura, este santo franciscano, doctor de la Iglesia, recibió un regalo: una de las personas que aquí y ahora más conocía de su obra, pensamiento y fuentes, iba a ir a visitarlo. Ambos tenían, al fin, la oportunidad de conocerse en persona. Para sus amigos fue un regalo muy caro. Nuestro amigo Francisco de Asís Clavero Blanco nos dejó físicamente, pero sus estudios y (...) su obra perdura y perdurará con nosotros.' Decir que alguien conoce a san Buenaventura no es fácil, pues en este pensador franciscano se conjugan aspectos filosóficos, teológicos, históricos y espirituales que llevan en sí una carga histórica compleja que se desarrolla en un tiempo, a la vez, complejo, apasionante y alejado en el tiempo: el siglo XIII. No en vano, la figura de san Buenaventura fue tildada por algunos como "la más medieval de la filosofía del Medioevo".Pero Francisco de Asís Chavero se preparó para afrontar este reto y más. Nacido en Rivera del Fresno en 1945, profesó en la Orden Franciscana en la Provincia Bética el 6 de agosto de 1967. Se ordenó presbítero el 21 de julio de 1973. Cursó filosofía y teología en el Centro de Estudios Teológicos de Sevilla, en la Facultad de Teología de Granada, en el Pontificio Ateneo Antonianum y en el Centro de Investigación de Quarachi de la Orden Franciscana situada en Grottaferrata en Roma. Estos estudios hicieron que quedara corta su titulación de Licenciado en S. Teología, sección Histórico?Dogmática. En el momento en el que le sorprendió la muerte era profesor de Teología Sistemática, Antropología Teológica y Pensamiento Franciscano en el Instituto Franciscano de Murcia.El perfil de su formación, trabajo y dedicación nos ayuda a comprender por qué a Francisco de A. Chavero no se le escapaba ningún detalle del pensamiento bonaventuriano. No había aspecto de su pensamiento filosófico, teológico, espiritual o franciscano que no conociera. Su obra, sus ediciones, las fuentes, los estudios e interpretaciones sobre el doctor Seráfico eran, no sólo conocidas por él, sino también estudiadas, pensadas e interpretadas. De todo lo que acabo de decir dan fe sus escritos y las extensísimas notas a pie de página que nos regalaba. Hablando de su trabajo siempre mostraba la visión de fondo que impregnaban sus estudios: el de historiador de la teología. Esto no significa que desde esta perspectiva histórica no fuera capaz de percibir y apuntar conceptos nuevos y visiones originales.Francisco de Asís Clavero Blanco colaboró en numerosas revistas como Verdad 1, Vida, Carthaginensia, Estudios Franciscanos, Doctor Seraphicus, Themata, Archivum Franciscanum Historicurn, etc. Era miembro de la Sociedad Escotista Internacional , del Centro di Studi Bonaventuriani , Asociación Hispánica de Estudios Franciscanos y compañero de la Sociedad Española de Filosofía Medieval . Me gustaría en estas páginas repasar aunque sea brevemente el legado intelectual de este pensador franciscano. (shrink)

This volume publishes the Proceedings of the 1st International Meeting "Thinking Baroque in Portugal" (26-28 June 2017), which dealt with the metaphysical, ethical and political thought of Francisco Suárez. Counting on the collaboration of some of the greatest international specialists in the work and thought of this famous professor of the University of Coimbra in the 17th century, this volume celebrates the 400th anniversary of his death and marks the productivity of his philosophical-theological legacy.

The writings and speeches of the Mexican president Andrés Manuel López Obrador (2018-2024) have been characterized by a constant reference to a teleological history. Using Karl Löwith’s proposals, I analyse the president’s liberal-progressive idea of history and I propose that in this respect he has followed a certain speculative philosophy of history, which I call philosophy of Trans-Historic-History.

El presente artículo busca establecer el origen y desarrollo del concepto de ley natural en Tomás de Aquino, especialmente la relación que se establece entre razón y voluntad. Recordemos que esta relación ha sido objeto de numerosos estudios, especialmente en referencia al mismo concepto en Francisco Suárez. El artículo trata el tema de manera objetiva y como testigo de lo que nuestro teólogo pensó y estableció en sus escritos. El éxodo de más de 5,6 millones de venezolanos representa un fenómeno migratorio con múltiples facetas, cada una merecedora de atento análisis y profundización. Ante la dimensión del movimiento de millones de seres humanos, se corre el riesgo de subestimar tragedias que ocurren dentro del drama migratorio. Una de ellas, es el exilio de científicos y académicos. Bajo esta perspectiva, la investigación tiene como objetivo general mostrar la banalización frente al riesgo de pérdida de talento y avance científico de países (...) en vías de desarrollo. Tomamos como objeto de estudio el caso de la Diáspora Científica Venezolana. Se abordan de forma multidisciplinar tres ejes temáticos: 1) Causas y consecuencias de la Ciencia en Riesgo, 2) Instrumentalización de la Ciencia en Riesgo y 3) Efectividad de programas dirigidos a científicos en riesgo. El primer eje temático, está fundamentado en analizar las causas y consecuencias de la Diáspora científica venezolana, centrándonos en los estudios realizados, desde el ámbito sociológico, de Iván de la Vega, Francisco Kerdel-Vegas y Tomás Páez. El segundo eje establece, desde el marco filosófico habermasiano-marcusiano, la conveniente preservación del statu quo de la Ciencia en riesgo, a través de instrumentalización y unidimensionalidad del quehacer científico en países en vías de desarrollo por parte de programas internacionales financiados por organismos privados y gubernamentales. El tercer y último enfoque tiene como punto de partida la situación actual de la diáspora científica y la exposición de soluciones eficaces que rompan la inercia presente, enmarcando las ideas dentro de la actual crisis de la posmodernidad. Are feelings an essential part or aspect of emotion? Cases of unconscious emotion suggest that this is not the case. However, it has been claimed that unconscious emotions are better understood as either (a) emotions that are phenomenally conscious but not reflectively conscious, or (b) dispositions to have emotions rather than emotions proper. Here, I argue that these ways of accounting for unconscious emotions are inadequate, and propose a view of emotions as non-phenomenal attitudes that regard their contents as relevant (...) to one's motivations. Are emotions bodily feelings or evaluative cognitions? What is happiness, pain, or “being moved”? Are there basic emotions? In this chapter, I review extant empirical work concerning these and related questions in the philosophy of emotion. This will include both (1) studies investigating people’s emotional experiences and (2) studies investigating people’s use of emotion concepts in hypothetical cases. Overall, this review will show the potential of using empirical research methods to inform philosophical questions regarding emotion.

The metaphysics of gender and race is a growing area of concern in contemporary analytic metaphysics, with many different views about the nature of gender and race being submitted and discussed. But what are these debates about? What questions are these accounts trying to answer? And is there real disagreement between advocates of differ- ent views about race or gender? If so, what are they really disagreeing about? In this paper I want to develop a view about what the debates (...) in the metaphysics of gender and race are about, namely, a version of metaphysical deflationism, according to which these debates are about how we actually use or should use the terms ‘gender’ and ‘race’ (and other related terms), where moral and political considerations play a central role. I will also argue that my version of the view can overcome some recent and powerful objections to metaphysical deflationism of- fered by Elizabeth Barnes (2014, 2017). (shrink)

The central aim of the present investigation is to shed light on Nietzsche’s understanding of happiness and a good life, starting from Nietzsche’s appropriation of Plato’s and Aristotle’s doctrine of a hierarchy of human beings and forms of life.

A recent quarrel over faultless disagreements assumes that disputes over evaluative sentences should be understood as regular, factual disagreements. Instead, I propose that evaluative disagreements should be understood in Lewisian terms. Language use works like a rule-governed game. In it, the assertion of an evaluative sentence is an attempt to establish one value as default in the conversation; its rejection, in turn, is in most cases the refusal to accept this move.

El presente artículo tiene como objeto llevar a cabo un estudio pragmático y analítico sobre la acción de valoración, el valor y los valores a la luz de la ciencia semiótica y de la ciencia cibernética. Por ello, se desarrollará un proceso axiológico que ilustre cómo sucede el ingreso, la transición y la salida de códigos morales en función de un esquema cognitivo. Así pues, el proceso axiológico se postula, primero, en fundamento de tres sistemas: de mentalidad, de valores y (...) de biomoralidad y, segundo, conforme a la teoría de la información y de la teoría general de sistemas. This paper discusses the logical space of alternative conceptual engineering projects, with a specific focus on (1) the processes, (2) the targets and goals, and (3) the methods of such projects. We present an overview of how these three aspects interact in the contemporary literature and discuss those alternative projects that have yet to be explored based on our suggested typology. We show how choices about each element in a conceptual engineering project constrain the possibilities for the others, thereby giving (...) rise to distinct groupings of possible projects under the banner of conceptual engineering. We conclude with a critical reflection on the potential ethical issues that arise as a result of effectively putting conceptual engineering into practice. (shrink)

It is an intimate experience for us to think, to understand and to perceive things as being identical to themselves, and to suppose, consequently, that things are truly “what” they are. Something is always conceived as itself. The given is given full of itself in all its modifications. For instance, I can think or perceive partially some lips, I can see them almost in their whole or in some of their aspects, or just see them disappear. But it does not (...) seem to be possible to think or to perceive a given as almost itself, as an aspect or as part of itself. It is the aim of this work to study the assumptions and conditions for the original position of sameness in experience, just as it occurs in the synthesis of the datum singular and distinct. The polarization of single tone (einstimmig) intentional rays in an αvτó already contains the aporiae peculiar to the experience of the identical, whose revelation shall lead us, on the one hand, to one of the nuclei of the analysis of passive synthesis, and, on the other hand, to point up how critical revision of the numerical or extensional model of self-identity is for the unity of meaning. Then, it will be a question of pointing out the reasons why in a phenomenology of identity, the renunciation of the phenomenological legitimacy of the αvτó as a guarantee for the different positions of identity must be observed. Conceptual engineering means to provide a method to assess and improve our concepts working as cognitive devices. But conceptual engineering still lacks an account of what concepts are (as cognitive devices) and of what engineering is (in the case of cognition). And without such prior understanding of its subject matter, or so it is claimed here, conceptual engineering is bound to remain useless, merely operating as a piecemeal approach, with no overall grip on its target domain. The purpose of this (...) programmatic paper is to overcome this knowledge gap by providing some guidelines for developing the theories of concepts and of cognition that will ground the systematic unified framework needed to effectively implement conceptual engineering as a widely applicable method for the cognitive optimization of our conceptual devices. Conceptual engineering is the method for assessing and improving our concepts. However, little has been written about how best to conceive of concepts for the purposes of conceptual engineering. In this paper, I aim to fill this foundational gap, proceeding in three main steps: First, I propose a methodological framework for evaluating the conduciveness of a given concept of concept for conceptual engineering. Then, I develop a typology that contrasts two competing concepts of concept that can be used in conceptual (...) engineering — namely, the philosophical and psychological ones. Finally, I evaluate these two concepts of concept using the proposed methodological framework and I show that, when it comes to making conceptual engineering an actionable method, the psychological concept of concept outclasses its philosophical counterpart on all counts. This provides a baseline from which the concept of concept can be further improved for the purposes of conceptual engineering. (shrink)

The bridges of Königsberg case has been widely cited in recent philosophical discussions on scientific explanation as a potential example of a structural explanation of a physical phenomenon. However, when discussing this case, different authors have focused on two different versions, depending on what they take the explanandum to be. In one version, the explanandum is the _failure_ of a given individual in performing an Eulerian walk over the bridge system. In the other version, the explanandum is the _impossibility_ of (...) performing an Eulerian walk over the bridges. The goal of this paper is to show that only the latter version amounts to a real case of a structural explanation. I will also suggest how to fix the first version, and show how my remarks apply to other purported cases of structural explanations. (shrink)

The Enhanced Indispensability Argument appeals to the existence of Mathematical Explanations of Physical Phenomena to justify mathematical Platonism, following the principle of Inference to the Best Explanation. In this paper, I examine one example of a MEPP—the explanation of the 13-year and 17-year life cycle of magicicadas—and argue that this case cannot be used defend the EIA. I then generalize my analysis of the cicada case to other MEPPs, and show that these explanations rely on what I will call ‘optimal (...) representations’, which are representations that capture all that is relevant to explain a physical phenomenon at a specified level of description. In the end, because the role of mathematics in MEPPs is ultimately representational, they cannot be used to support mathematical Platonism. I finish the paper by addressing the claim, advanced by many EIA defendants, that quantification over mathematical objects results in explanations that have more theoretical virtues, especially that they are more general and modally stronger than alternative explanations. I will show that the EIA cannot be successfully defended by appealing to these notions. (shrink)

En su trabajo acerca del debate Putnam-Rorty, Luis Robledo supone una concepción reduccionista de la justificación en Rorty, y defiende contra ella la indepen-dencia entre justificación y consenso, a través del argumento de la posibilidad de un consenso sin justificación. A su juicio, el no sostener una independencia tal conduciría a problemas desfavorables para el pragmatismo. En este trabajo buscaré presentar una interpretación alternativa y no reduccionista de la justificación rortiana, que aún sin reconocer una total independencia entre ambas instancias, (...) no sólo evita estos proble-mas, sino que además muestra que es poco pragmático el ejemplo proporcionado por Robledo en su argumentación. El objetivo principal del artículo es hacer notar la dimensión jurídico-normativa del problema del aborto, considerando que acentuar excesivamente su dimensión ético-moral conduce a una estéril contraposición que impide una discusión serena del abortoy de su dimensión irremediablemente pública. En este sentido, aún reconociéndole su perspectiva moral, en el artículo se plantea la posibilidad de pensar el aborto como una conducta que pueda reconducirse a un modelo de regulación jurídica “blando”, dondela perspectiva moral del legislador no adquiera las características de (...) una moral común, igual para todos ,y que,por el contrario,mediante la modalidad jurídica del permiso, cada individuo ponga en acto su propia convicción moral. De ahí puede surgir una legislación en la que el aborto no sea objeto ni de un deber jurídico ni de una prohibición: abortaro no abortar, en este modelo de regulación jurídica, son decisiones que los individuos toman con base en sus propias convicciones. Conceptual engineering is the method for assessing and improving our concepts. Some have recently claimed that the implementation of such method in the form of ameliorative projects is truth-driven and should thus be epistemically constrained, ultimately at least (Simion 2018; cf. Podosky 2018). This paper challenges that claim on the assumption of a social constructionist analysis of ideologies, and provides an alternative, pragmatic and cognitive framework for determining the legitimacy of ameliorative conceptual projects overall. The upshot is that one should (...) not ameliorate for the sake of truth or knowledge, in the case of ideologies—at least, not primarily. (shrink)

La teoría de los hacedores de verdad, como la vieja teoría correspondentista, intenta comprender la relación que, ligando proposiciones y hechos, resulta en la verdad (o falsedad) de las primeras. Esta teoría presenta una versión débil, que da cuenta de dicha relación en términos de la noción de implicación, y una fuerte, fundada en la relación de "ser verdadero en virtud de". La diferencia fundamental entre ambas es la adhesión y el rechazo, respectivamente, del Principio de Implicación, según el cual (...) dos proposiciones ligadas por implicación serán hechas verdaderas por el mismo hecho. El presente trabajo muestra cómo esta adhesión conduce a las versiones débiles al colapso, por lo cual sólo las versiones fuertes tienen oportunidades de prosperar. (shrink)

Conceptual engineering is the method for assessing and improving our representational devices. On its ‘broad-spectrum’ version, it is expected to be appropriately applicable to any of our representation-involving cognitive activities, with major consequences for our whole cognitive life. This paper is about the theoretical foundations of conceptual engineering thus characterised. With a view to ensuring the actionability of conceptual engineering as a broad-spectrum method, it addresses the issue of how best to construe the subject matter of conceptual engineering and successively (...) defends the theses that conceptual engineering should be: (i) About concepts, (ii) psychologically theorised, (iii) as multiply realised functional kinds. Thereby, I claim to theoretically secure and justify the maximum scope, flexibility, and impact for the method of conceptual engineering on our representational devices in our whole cognitive life—in other words, a broad-spectrum version of conceptual engineering. Evaluative judgments imply positive or negative regard. But there are different ways in which something can be positive or negative. How do we tell them apart? According to Evaluative Sentimentalism, different evaluations (e.g., dangerousness vs. offensiveness) are grounded on different emotions (e.g., fear vs. anger). If this is the case, evaluation differentiation requires emotional awareness. Here, we test this hypothesis by looking at alexithymia, a deficit in emotional awareness consisting of problems identifying, describing, and thinking about emotions. The results of (...) Study 1 suggest that high alexithymia is not only related to problems distinguishing emotions, but also to problems distinguishing evaluations. Study 2 replicated this latter effect after controlling for individual differences in attentional impulsiveness and reflective reasoning, and found that reasoning makes an independent contribution to evaluation differentiation. These results suggest that emotional sensibilities play an irreducible role in evaluative judgment while affording a role for reasoning. (shrink)

It is generally assumed that emotion concepts are purely descriptive. However, recent investigations suggest that the concept of happiness includes information about the morality of the agent's life. In this study, we argue that normative influences on emotion concepts are not restricted to happiness and are not about moral norms. In a series of studies, we show that emotion attribution is influenced by whether the agent's psychological and bodily states fit the situation in which they are experienced. People consider that (...) emotions are not just about feeling in certain ways, but also about feeling the right way. (shrink)
